Yes, this man deserves the death sentence. At least one prior suspect did as well, for the premeditated double murder of his ex-wife and her boyfriend. The case had overwhelming evidence and a total confession, but DuBain played the political game when the Mexican government objected. Now he's trying to placate the police organizations who can't stand him, by seeking death for the cop killer. While I agree Henry Smith deserves the death sentence, I naively yearn for a district attorney with the stones to do the right thing EVERY TIME!!

G-Man, we have a disease in this city that has nothing to do with the elements. Most of its components are inexplicable and we are not privy to their cause. It has plagued us for years and just keeps coming back. This particular illness attacks an area of the brain that deprives the critical thinking process and is most commonly found in and around the DA’s office. Until we find a proper cure all of us will continue to suffer from the effects.

I do not like this decision at all. The death penalty is often considered a threat to winning a case. Since this is California chances of him getting executed are pretty much zero, so why waste the time and resources? The number of yes votes shows the obvious emotionally driven response. It is fine that you might like to see the man executed. But it is unrealistic in this environment to think it might happen. Plea him to life without, move on.

Everybody wants him to get the big one but this is California not Texas. Hundreds of millions will be spent on Dubain's pals, the trial lawyers, and the accused will never be put to death. But in California, equally loathsome lawyers will get rich. California's thought and reason challenged voters even voted for more of the same----billions spent on lawyers with endless appeals but no condemned actually put to death. Dubain is using emotional thinking, illogical thinking, platitudes and sophistry of reason to help himself and his lawyer pals. And you get to pay for it. Most of you years from now will have forgotten this case and won't see the bills for endless appeals paid for by you. Think about it.
