This letter is in response to a letter by John Takeuchi which, in turn, was in response to a previous letter I sent.
In his letter, Mr. Takeuchi cites four instances where he says President Barack Obama has not taken care that the laws of the United States be faithfully executed as required by the Constitution.
First, he states, “this president refuses to enforce laws on illegal immigration.” However, Mr. Takeuchi does not state what immigration laws he is referring to nor does he cite an instance or instances where President Obama refused to enforce those laws.
Second, Mr. Takeuchi states the president “refuses to defend the Defense of Marriage Act.” However, the part of the Constitution he cites does not require the president to defend a law before the federal courts. It only requires him to enforce the law, which President Obama’s administration is doing.
Third, Mr. Takeuchi said the president “allowed gun-trafficking laws to be violated by his Department of Justice,” a reference to Operation Fast and Furious. In order for the president to have “allowed” those laws to be violated, he would have to have been aware the illegal actions were being undertaken either before or during their execution. How can Mr. Takeuchi state a person “allowed” something to happen in they were not aware it was happening? There is no evidence President Obama was aware of the existence or details of Operation Fast and Furious before or during its being executed.
Fourth, Mr. Takeuchi states President Obama subverted bankruptcy laws in the Solyndra case. Like in the first example above, Mr. Takeuchi does not state which bankruptcy laws he is talking about and, therefore, I cannot evaluate his contention that those laws were subverted.
