Murder suspect to stand trial again in November

FAIRFIELD — The suspect in a 2003 stabbing death of a retired nurse in her Fairfield home was ordered Wednesday to again stand trial on a murder charge starting Nov. 14.

Ricardo Cruz was arrested in 2011 after a sample of his DNA was matched to DNA obtained from under one of Kathryn Vitagliano’s fingernails during an autopsy. Vitagliano was fatally stabbed while she prepared a family Thanksgiving dinner alone at her Robin Drive home on Nov. 26, 2003.

Cruz, an ex-boyfriend of one of Vitagliano’s adult daughters, went through a monthlong jury trial that ended two weeks ago with a jury deadlocked 8-4 in favor of a not-guilty verdict.

Cruz did not testify at his trial, but told police that he had been at his home asleep and sick on the day Vitagliano was killed.

Judge Peter B. Foor rejected a request by Cruz’s attorney to set bail.
