FAIRFIELD — Jury selection got underway Wednesday in the third murder trial for a Fairfield man who shot and killed a 17-year-old Vallejo drug dealer in 2008 during a botched robbery attempt.
Deshaun P. Malone convinced Kendrick Lewis to drive to Fairfield and sell him $200 of Ecstasy tablets. Malone walked up to Lewis’ stopped car on Mockingbird Lane and they started their transaction, and Malone pulled a gun. As Lewis started to drive off, a shot was fired. Lewis – shot in the back – died a short time later.
During his first trial in 2010, Malone said the shooting had been an accident. Jurors did not believe him and found him guilty of first-degree murder. That conviction was overturned by the Court of Appeal, which ruled jurors should have had the chance to find Malone guilty of manslaughter instead of murder.
Malone’s second jury trial was cut short last week when jurors learned of the previous jury’s verdict.
